This website is operated by RMD Consulting LLC, doing business as 1031 ROADMAP™. This policy explains what information we collect through the site, why we collect it, and what we do with it. It is written in plain language on purpose.
Who we are
RMD Consulting LLC is a tax consulting practice led by Michael De Luz, an Enrolled Agent admitted to practice before the Internal Revenue Service. We advise property owners on the tax consequences of Section 1031 like-kind exchanges. We are not a broker, a lender, a qualified intermediary, a law firm or an investment adviser.
Information you give us
You choose what to send us. Depending on how you get in touch, that may include:
- Your name, email address and telephone number.
- Details about a property you are considering selling — for example the state it is in, the expected sale price, the mortgage or other debt outstanding on it, the original purchase price, improvements, depreciation claimed, and how title is held.
- Where you are in your transaction timeline, and anything else you type into a message field.
- Anything you tell us when you book or attend a consultation.
None of the fields on our contact form are required beyond a name and an email address. Please do not send Social Security numbers, taxpayer identification numbers, bank account numbers or copies of tax returns through the website. If we need documents of that kind, we will tell you how to send them securely.
Information collected automatically
Our host, WP Engine, keeps standard server logs that include IP addresses, browser and device information, the pages requested and the time of the request. These logs exist for security, troubleshooting and abuse prevention. We do not use them to build advertising profiles.
Scheduling and other third-party services
Appointment booking on this site is provided by Calendly. When you open the scheduler, Calendly loads content from its own servers and collects the information you enter to book a meeting, subject to Calendly’s own privacy policy. Meetings may take place by telephone or by Zoom. Our website is hosted by WP Engine and built on WordPress with the Elementor page builder. Contact form submissions are emailed to us and stored in the website database.
We do not run advertising networks, retargeting pixels or social media tracking on this site, and we do not sell or rent personal information to anyone.
How we use your information
- To respond to your enquiry and, where appropriate, to prepare a fee proposal.
- To analyse and model the tax consequences of a transaction you ask us about.
- To perform professional services under an engagement, including preparing and filing returns and forms.
- To meet our own legal, regulatory and professional record-keeping obligations.
- To keep the website secure and working.
Confidentiality of tax information
Information you provide in connection with tax services is subject to confidentiality obligations that go beyond this policy, including Internal Revenue Code section 7216 and the practice standards in Treasury Circular 230. In broad terms, we may not disclose or use your tax return information for a purpose other than preparing or assisting in preparing your return without your written consent, apart from limited exceptions permitted by law. Communications with an Enrolled Agent are also protected by the federally authorised tax practitioner privilege in Internal Revenue Code section 7525 in the circumstances that provision covers. Nothing in this policy is intended to reduce those protections.
Who we share information with
We share information only where it is necessary, and only with:
- Service providers who operate parts of our infrastructure — hosting, email, scheduling, document handling and professional software — and who are bound to use it only to provide that service.
- Other professionals involved in your transaction, such as your attorney, broker, qualified intermediary, escrow officer or existing accountant, where you have asked or authorised us to work with them.
- Government authorities, where we are required to file, respond or produce information under law, or where you have authorised us to represent you.
We do not sell personal information, and we do not share it for cross-context behavioural advertising.
How long we keep it
Enquiries that do not lead to an engagement are kept only as long as they are useful, and then deleted. Records connected to professional services are retained for as long as professional standards, tax statutes of limitation and our own legal obligations require — which, for exchange work, can be many years, because a deferred gain remains relevant until it is finally recognised.
Security
The site is served over encrypted connections and access to our systems is restricted. No method of transmission or storage is perfectly secure, so please use the secure channels we give you for sensitive documents rather than email or web forms.
Your choices
You can ask us what personal information we hold about you, ask us to correct it, ask for a copy, or ask us to delete it. Write to the address below and we will respond within the time the applicable law allows. Some information cannot be deleted on request where we are required to retain it — tax records are the usual example.
California residents have specific rights under the California Consumer Privacy Act as amended, including the right to know, the right to delete, the right to correct and the right to opt out of sale or sharing. We do not sell or share personal information as those terms are defined in that statute, so there is nothing to opt out of, but the other rights are available to you and we will not discriminate against you for exercising them.
Cookies
The site uses a small number of functional cookies needed to operate WordPress and to remember display preferences. Third-party embeds such as the scheduler may set their own. You can block or delete cookies in your browser settings; the site will still work, though the scheduler may not.
Children
This site is intended for property owners and their advisers. It is not directed to children, and we do not knowingly collect information from anyone under sixteen.
Changes to this policy
If we change how we handle information we will update this page and change the date at the top. Material changes will be described here rather than made quietly.
